Re : ANNOUNCEMENT OF QUESTIONABLE PRESIDENTIAL VOTE RESULTS
I, Edward Lowassa, the Chama Cha Demokrasia na Maendeleo (CHADEMA) Presidential Candidate and Honourable Juma Duni Haji – the Vice Presidential candidate , wish to make it known that we do not accept the questionable presidential polling results that the Deputy Chairperson of NEC continues to announce to the public. These results are contrary to the ones that obtained at the polling stations as well as the constituencies/councils’ level.
As per the Regulation 65(1) of the Presidential and Parliamentary Election Regulations of 2015, NEC is required to verify the Presidential Poll results prior to disseminating them to the public. This is however, not happening because no verification is being done by NEC and as a result of this the results being released are doctored and in essence, illegal. For, there is a huge mismatch between the votes being announced by NEC and those that were aggregated at polling station level in the various constituencies.
Cap 35F(6) of the Elections Act, Chapter 343 of 2010, empowers NEC to order a recount of the Presidential votes in either some or all the constituencies.
Enclosed herein please find copies (Appendix ‘A’) that clearly shows the results announced by the National Electoral Commission and the actual results that were aggregated at Constituency and/or Council level.
I therefore wish to humbly request you to stop the announcement of the presidential results until the votes have been recounted and aggregated through the forms from the polling stations and not through the current IT system. CHADEMA has in the past lodged its complaints about the presidential votes aggregation process. The UKAWA Parliamentary Candidates have their part also done the same at constituency level.
I am putting this request to you knowingly fully well that Cap 41 (7) of the Constitution of the United Republic of Tanzania does not allow for the questioning of the Presidential Votes in any court of the land. The only avenue available to us, is therefore Cap 35F(6) of the Elections Act and Regulation 61 (5) of the Parliamentary and Presidential Regulations as mentioned above.
Yours in the spirit of democracy and development.
Lowassa Edward Ngoyai
CHADEMA’S United Republic of Tanzania’s Presidential Candidate
